LEGAL TERMS AND CONDITIONS tQel 2025 GIVEAWAYS

CLAUSE 1.- ORGANIZING COMPANY

Khore Global Consulting S.L. (hereinafter "tQel dog trends" or "the company"), with Tax ID (CIF) B84463868, with registered office in Madrid, at Avenida de Ramón y Cajal 111, postal code 28043; is organizing the "Valentine's Day" giveaway. It invites those who wish to participate in the special Instagram giveaway for the tQel brand.

 

CLAUSE 2.- RULES APPLICABLE TO THE GIVEAWAY

The giveaway will be conducted in accordance with these legal terms and conditions, under the 'GIVEAWAY' modality.

The giveaway rules will be included in the tQel profile's bio.

The mere act of participation, by any of the means contemplated in these terms, implies unconditional acceptance thereof. tQel reserves the right to remove any participant from the giveaway who does not comply with the legal terms and conditions at any time during the giveaway.

 

CLAUSE 3.- PURPOSE OF THE GIVEAWAY

To participate, users must meet the following Instagram requirements:

*Like the post.

*Tag, as many times as you want, but each comment must include two mentions of friends who own dogs.

 

CLAUSE 4.- DURATION

The giveaway will begin on February 10, 2025, when the Giveaway post is published on @tqel's Instagram, with the participation period ending on February 16, 2025, at 11:59 PM. Entries received after this time will not be eligible to participate. The winner will be announced on February 17 at 7:00 PM; the giveaway will be held live and a recorded version will be uploaded to social media via a stories post, using the Appsorteos platform.

However, the brand reserves the right to extend the deadline, if necessary and after prior publication.

 

CLAUSE 5.- PARTICIPATION CONDITIONS

The giveaway is open to all tQel followers who wish to participate or those who start following us after the publication.

The winner of the giveaway agrees to publish a post and a story on their Instagram account, indicating that they were the winner, with an unboxing of the prize product.

 

CLAUSE 6.- PROTECTION OF MINORS

Minors may not participate, nor may accounts exclusively dedicated to Giveaways or promotions. Profiles must be open on the day of the giveaway to verify that the participant is indeed a follower of our profile. If the profiles do not comply with what is requested in the Legal Terms, the winner will be disqualified, and another participant will be chosen.

 

CLAUSE 7.- GIVEAWAY MECHANICS

Participants wishing to qualify for prizes must meet the aforementioned requirements. All residents of Spain or Portugal may participate; shipping to the Iberian Peninsula or the Balearic Islands is included. If you live in the Canary Islands or Portugal, you can participate by covering the shipping costs yourself. The giveaway is not available for other countries.

The process will be:

*Like the post.

*Tag 2 friends who own dogs in the comments.

On February 16, the post will be hidden at 11:59 PM and reactivated on February 17 to conduct the giveaway.

The winner will be chosen through a draw using the Appsorteos platform. The winner must meet the requirements. There will be only one winner selected by drawing. In addition, 1 alternate will be chosen, who will become the winner if the original winner renounces the prize, does not respond within the indicated period, or does not comply with the requirements established in these legal terms.

The actual delivery of the prize will be agreed upon with the giveaway winner.

 

CLAUSE 8.- PRIZE

One Snoozy Bag Laponia Choco size M from the tQel brand.

 

CLAUSE 9.- COMMUNICATION TO THE WINNER AND PRIZE DELIVERY

Through a story post on @tqel and a direct message (DM) we will send. If the winner does not respond within 24 hours, it will be understood that they waive the prize won, and we will proceed to contact the alternate; however, in no case will it be exchangeable for another product or for cash payment. The prize is personal and non-transferable.

The giveaway winner must confirm their prize within a maximum of 24 hours. If they do not do so or if no response is received, tQel will award the prize to another winner selected from the reserves, and the same prize confirmation protocol will be followed within 24 hours. If none of the reserves confirm their prize, it will be declared void.

 

CLAUSE 10.- DATA PROTECTION

a. Data Controller:

The personal data you provide within the framework of the contest will be processed by tQel.

b. Purposes of processing and legal basis thereof:

To provide access to and manage the giveaway, in accordance with the details provided in the terms and conditions. The provision of promotion services, in accordance with the participant's registration therein.

To comply with the obligations and responsibilities of the promotion services, in accordance with the details provided in these terms and conditions.

Compliance with the Giveaway Terms, in relation to their content:

To manage and execute the legal obligations and responsibilities arising from the content of the giveaway, in accordance with the details provided in these terms and conditions.

Compliance with laws; in the part corresponding to it, in relation to the content of the giveaway.

To send you commercial information about offers, news, promotional events (newsletters and other information) from tQel.

c. Recipients of the data (Who will receive the data?)

Carrier for the purpose of sending and delivering gifts associated with winners or beneficiaries of contests.

The identification data of the winners or beneficiaries of the giveaway may be disseminated in corporate media at national, international level and/or through the channels or media where said contest is developed or the names of the winners are published, without this entitling them to any remuneration or benefit (with the exception, where applicable, of the delivery of the prize or benefit obtained). Likewise, participation in the giveaway and/or action necessarily implies that the identification data and status of the winner are published in the media that the responsible entity deems appropriate.

The entity uses the social networks Instagram, Facebook, LinkedIn, and TikTok. Interaction with users through the use of these profiles or tools implies the international transfer of data, of an analytical and technical nature in relation to the page and social network profiles, with the servers of each company being where the data provided by users through these profiles is processed. For more information on the processing of your data, please consult the respective Data Protection policies of the social network controllers.

d. Data retention period:

Data associated with participation in contests: duration of the giveaway.

Data provided for Newsletter or news bulletin subscription: until you unsubscribe and after the associated statute of limitations for data processing has passed.

In general, the responsible entity may retain data that is necessary to comply with the various statute of limitations periods associated with legal obligations or the exercise and development of legal actions.

In any case, the data will be deleted when its processing is no longer required, removing it from our records in a way that does not allow its identification.

e. Rights of data subjects

You can exercise your rights of access, rectification, erasure, portability, and limitation or opposition by writing to the address: tQel dog trends C/ San Rafael 4B, local 13. 28108 Alcobendas, Madrid, indicating the reference “Data Protection” or by sending an email from the address you used to participate to hello@tqel.es.

CLAUSE 12.- APPLICABLE LAW AND JURISDICTION

These terms and conditions are governed by Spanish law. Any dispute arising from the Contest will be subject to the Courts of Madrid, with express waiver of any other jurisdiction that may apply.

These Terms are established in Alcobendas, on February 10, 2025.
